i could foresee something like this happening in the future but i think theyre wrong to sue ebay, the courts should just order ebay to reveal the details of the people who are selling the fake shit.

The same case as in Asia, where there are two common "defenses" for such prolific piracy.

- The authorities don't have enough resources to combat such a large issue
- The authorities/government turn a blind eye to a bulk of it as they realise the amount of money it brings to the economy.

Usually the two cases work hand in hand, one resulting from the other. IE, the company let it slip for a while, people catch on to the idea of easy money from products seen as cheap alternatives by consumers, and thereafter the company or economy sort of rely on it. Just go to any market in Thailand, Indonesia, or China; the markets are flooded with pirated goods. If you were to take the right to sell such items away then you would ruin the local economy. Europe are well known for having very underdeveloped internet rules, hence why you get many of the large torrent servers and trackers over there. It is usually the USA or Canada that try shut them down.

You take a very small percentage of the fees you make from each of those auctions, and use it to fund some tighter controls. They're never going to stop it completely, but I believe the basis of this judgement was that they're not doing enough.

about a year ago trademe were advrtising a job for an investigative analyst to look at fraudulent use and stuff, so they are doing something... unfortunatly it doesn't stop it all though, and a guy i know got ripped off quite badly
police got onto them eventually though, the story was in the Taupo papers a few weeks back i believe

but yeah, best way is to use some common sense, don't go outside auction, look for people with good feedback, address verified etc, and if it looks too good to be true, it usually is

TBH, I dont have a problem with the 'style' products... as long as they are clearly identified as such..


Id be happier if Trademe policed people keywording/categorising their listings better - why the fuck would I want Mitsi GSR injectors, when Im searching for RX2 chrome trims?

They already have a policy against excessive and unrelated key words but they don't police it enough. Nothing worse than seeing an auction for a skyline and the keyword list is like

'nissan skyline gts gtr gtt gtst mazda honda ford holden mitsi evo integra type r wrx evo rx7 civic'

thats when you report it you cant expect trademe to know every detail about every car part etc etc ..

or make a thread with them and i can report them to my friend who works at trademe once or twice a week or something

I run a sneaker forum where members regularly report to trademe on listings on fake nike, adidas, as well as fake clothing and from their feedback they either don't care, or don't do enough. Trademe IMO doesn't do enough and when they do these fraudmongers just set up another trading name and start all over again so I truly hope this has scared them into action.

I never really feel sorry for big fashion/clothing companies who cry foul at fakes. It's not like they invented shoes, sunglasses, or handbags- they merely make an arguably overpriced, variation on the same principle, by and large without apparent innovation.

Perhaps I'm just inherently unfashionable(no perhaps about it really!) but shoes are shoes, make them look how you want. I would feel concern at say, an original mechanical innovation being copied without due credit to the inventor, (perhaps because it fascinates me more than Dolce & Gabbana Sunglasses). But really, get up in arms over fake Nikes?!- they're all made by children, get over it!

WOW, is all I can immediately say. However, when thinking about a web development contract - the content of a site remains the intellectual property of the client, the page itself belongs to the developer. Any legal issues regarding the content are taken up with the client. In Ebay's case, the content is technically the sellers then? It is an interesting situation. Like, say a person sells a fake Bride seat on Trademe, would you prosecute Trademe? No. Then again, if you take the definition of "harbouring stolen goods" in great flexibility, you could possibly consider Trademe or any online auction site to be at wrong... but it doesn't seem that is the case.

For the credability of their site however, they could at least take some effort towards reducing the sale of pirated goods...

I would say that responsibility must fall with the people who are selling the goods, not the medium by which it is advertised. Especially for cases like trademe and ebay where they dont scrutinise and research every auction before it is listed.

What they could do however is make sellers disclose identification details prior to listing an auction so they could be better traced and investigated if needed.
